Divorce vs. Annulment in Manhattan

What is the difference?

Many people are under the misconception that it is simpler to get an annulment rather than a divorce and that if their marriage is annulled it means that there will be no record of their marriage ever having taken place.  This is not true at all.  An annulment is generally more time consuming than a divorce and thus it usually costs more money.  Even though your marriage is annulled, the marriage still remains on record.

A marriage that is eligible for annulment is known as a voidable marriage.  The contributing factors to a voidable marriage are when one or both parties are:

  • Under the age of consent
  • Incapable of consenting for want of understanding
  • Incapable of entering into the married state from physical cause
  • Only consent to marriage by reason of force, duress or fraud
  • Have an incurable mental illness for 5 years or more

The spouse that files for an annulment is required to show proof of one of the above grounds.  This can be a very complex and time consuming battle.  It may be less burdensome to file for a divorce rather than an annulment especially since our state now permits no fault divorces.  A Manhattan divorce attorney at The Kepanis Law Firm will be able to go over your options in detail with you and advise you on the best course of action for your circumstances.
