How is Maintenance Awarded in Manhattan Divorce?

Recently, our state established new "no-fault" grounds for divorce.  Along with this, new criteria for the payment of temporary maintenance (also known as spousal maintenance and alimony) went into effect.  These new guidelines allow for a swift resolution of payment of temporary maintenance.  They are intended to provide predictability and consistency to the payment of such awards, in the same way that child support is paid consistently according to a unique set of guidelines.

The new guidelines contain a fixed formula for calculating the amount of temporary maintenance to be awarded to a spouse.  They state that maintenance will be mandatory when one spouse's income is two-thirds or less than that of the other spouse.  In the event that this income limit is met, the exact maintenance amount is formulated in two ways:

  • The first formula involves taking 30% of the income of the higher-earning spouse, and from that subtracting 20% of the income from the lower-earning spouse.
  • In the second formula, 40% is taken from the income of both spouses together, and from that is subtracted the entirety of the lower-earning spouse's income.
